4. USE WITH YOUR MOBILE DEVICE

Use of our Online-Services may be available through a compatible mobile device and Internet access. You agree that you are solely responsible for these requirements, including any applicable changes, updates, and fees as well as the terms of your agreement with your mobile device and telecommunications provider.

eTAX-VC makes no warranties or representations of any kind, express, statutory, or implied as to:
 

1. The availability of telecommunication services from your provider and access to the service at any time or from any location.
    

2. Any loss, damage, or other security intrusion of the telecommunication services.
    

3. Any disclosure of information to third parties or failure to transmit any data, communications or settings connected with the telecommunication services.

5. YOUR PERSONAL INFORMATION

We want to be transparent about how we use personal information and about your rights in our Global Privacy Statement. You should only provide us with personal information of others if you have received permission to do so. More on this subject you’ll find in our Global Privacy Statement.

eTAX-VC operates globaly and may access or store personal information in multiple countries, including countries outside of your own country to the extent permitted by applicable law.

6. Content

You are Responsible for Uploaded Materials
You are responsible for all materials ("Content") uploaded to your account through your use of the Online-Services. eTAX-VC is not responsible for the Content or data you submit through the Online-Services.

You agree not to use, nor permit any third party to use, the Online-Services to upload, engage in or transmit any of the following, including but not limited to:

​

1. Content that would impersonate someone else or falsely represent your identity or qualifications, or that constitutes a breach of any individual's privacy.
    

2. Investment offers, solicitations, chain letters, pyramid schemes, other unsolicited commercial messages, spamming or flooding, unless explicitly permitted in writing by VauntCourier.
    

3. Any disruptive or destructive program or data, such as a virus, trojan horse, worm, etc.
    

4. Any data, software, or content which is legally not yours and/or without permission from the copyright holder or the intellectual property rights owners.

The Use of Feedback You Provide
You agree that eTAX-VC may use your feedback, suggestions, or ideas in any way, including in future modifications of the Online-Services, other products or services, advertising, or marketing materials. You grant eTAX-VC a perpetual, worldwide, fully transferable, sublicensable, non-revocable, fully paid-up, royalty free license to use the feedback you provide to eTAX-VC in any way.

7. Your Account

Verification
You will have to sign up for an account to use the online app. We will need to verify your identity via email, and you authorize us to collect your email address to do so. You may not be able to use our Service if you fail to provide this information, authenticate to the account, or verify your identity.

Lost or Stolen Account Information
If you believe that your account information or the device that you use to access the Platform has been lost or stolen, or that someone is using your account without your permission, you must notify us immediately. To do so please use our websites contact form where you choose “Lost or stolen account information” from the subject drop-down menu.

Account Management
You are the only person authorized to use your account and account password. You are responsible for all submitted personal and tax information in your account,  for securely managing your online app login password(s) and contacting eTAX-VC if you become aware of any unauthorized access to your account (see above instructions).
For security reasons, your eTAX-VC login password is stored encrypted in our databases without us being able to change or access it. If a lost or stolen password is reported to us, we will email you instructions on how to create a new one.

Updates, Beta and Pre-Released Features
From time to time, we may update the online app, including with tools, utilities, improvements, or third-party applications. You agree to receive these updates.

​

You might get access to online app beta features from us. They are offered "as is", but you are free to utilize them. Also, the online app may contain pre-release and trial features that are new and/or updated; these features are offered "as is". There are no additional charges for using these features, but you must comply with any additional policies or restrictions we may impose on your use.

Cancellation, its Effects and Data Survival
This Agreement is effective until you request cancellation and deletion of your account through the contact form on eTAX-VC.com or VauntCourier terminates this Agreement/your account. In addition, we may suspend the online app at any time in our sole discretion.

​

eTAX-VC’s user-accounts are free of cost in general. If you cancel your first order, never order our Online-Services again, or your tax situation changes beyond a standard tax return and is no longer covered by our Terms of Service, we may terminate a free and unused account at any time.  

​

A cancellation by you or through a eTAX-VC termination of your account, effects that you can no longer login and use your online app account. No termination will affect your obligation to pay all fees due or that may have accrued through the effective date of termination or entitle you to any refund.

​

Any cancellation, termination, or discontinuance of the online app eTAX-VC.com or your account will not affect the following Sections: “Your Personal and Tax Information”, “Payments and Cancellations” (with respect to fees due and unpaid), “Effect of Termination”, “Disclaimers”, “Limitation of Liability”, “Indemnity Obligations”, “Disputes” and “General Terms (Miscellaneous)”.

 If a user only bought once and then "abandoned" their account, it's basically free!

8. ADDITIONAL TERMS

We may offer you other VauntCourier services
You may be offered other services, products, or promotions by VauntCourier ("VauntCourier Services"). Additional terms and conditions and fees may apply. You grant VauntCourier permission to use information about your tax situation and experience to help us to provide the VauntCourier Services to you and to enhance the Online-Services. You grant VauntCourier permission to combine your tax situation data, if any, with that of others in a way that does not identify you or any individual personally. You also grant VauntCourier permission to share or publish summary results relating to research data and to distribute or license such data to third parties.

Communications
eTAX-VC may be required by law to send you communications about the Services. You agree that eTAX-VC may send these communications to you via email or by posting them on our websites

 

Telephone Numbers
You may provide us with your telephone number as part of your customer record or registration or via other methods. You agree that eTAX-VC may send automated text messages to your provided telephone number for limited purposes, including: providing you with important and/or critical notices regarding your use of the Online-Services, or fulfilling a request made by you through the Online-Services.

9. GENERAL TERM

Disclaimer of Warranties
Your use of the online-services, software, and content is entirely at your own risk. Except as described in this agreement, the Online-Services are provided "as is". To the maximum extent permitted by applicable law, VauntCourier and its third-party providers, licensors, distributors or suppliers (collectively,"suppliers") disclaim all warranties, express or implied, including any warranty that the Online-Services are fit for a particular purpose, title, merchantability, data loss, non-interference with or non-infringement of any intellectual property rights, or the accuracy, reliability, quality or content in or linked to the Online-Services. VauntCourier and its suppliers do not warrant that the Online-Services are fully secure, free from bugs, viruses, interruption, errors, theft or destruction. If the exclusions for implied warranties do not apply to you, any implied warranties are limited to 60 days from the date of purchase or delivery of the Online-Services, whichever is sooner.

VauntCourier and its suppliers disclaim any representations or warranties that your use of the online-services will satisfy or ensure compliance with any legal obligations or laws or regulations.

Limitation of Liability and Indemnity
To the maximum extent permitted by applicable law, the entire liability of VauntCourier  and its suppliers for all claims relating to this agreement shall be limited to the amount you paid for the online-services during the twelve (12) months prior to such claim. Subject to applicable law, VauntCourier and its suppliers are not liable for any of the following:

​

1. indirect, special, incidental, punitive or consequential damages.
    

2. Damages relating to failures of telecommunications, the internet, electronic communications, corruption, security, loss or theft of data, viruses, spyware or use of software or hardware that does not meet eTAX-VC online app requirements.
    

The above limitations apply even if VauntCourier and its suppliers have been advised of the possibility of such damages. This agreement sets forth the entire liability of VauntCourier and your exclusive remedy with respect to the Online-Services and its use.

You agree to indemnify and hold VauntCourier and its suppliers harmless from any and all claims, liability and expenses, including reasonable attorneys' fees and costs, arising out of your use of the Online-Services or breach of this Agreement (collectively referred to as "Claims"). VauntCourier reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any Claims. You agree to reasonably cooperate as requested by VauntCourier in the defense of any Claims.

Processing Fees
All users have the right to cancel an order after digitally signing and/or agreeing to this Agreement. Any cancellation after signing this Agreement or registering for the Online-Services on eTAX-VC.com, but before VauntCourier has started preparing your tax returns, no processing fee will be charged.

eTAX-VC charges a processing fee of $75 for the following circumstance:

​

• A cancellation of a current order in your eTAX-VC account under “My Orders”, after the tax preparation status on the account page “My Tax Information” is set to
                        .

The processing fees will be deducted from the at then-current purchase amount. The difference will be credited to you as described in Section 3 under "Refunds via PayPal". If there is an additional payment resulting from the difference, we will invoice you by e-mail. To settle the additional payment amount, please follow the instructions on the invoice.

Agreement Changes
We may modify the provisions of this Agreement at any time. We may notify you of such modifications by posting through the online app or on eTAX-VC.com or by other means. It is important that you review this Agreement whenever we modify it because your continued use of the Platform indicates your agreement to the modifications. We may modify, suspend, or discontinue the Platform at any time. You agree that we will not be liable to you or any third party for any modification, suspensions, or discontinuance of the online app.

In some cases, you may need to accept changes to this Agreement to continue using the Platform. If you do not agree to the changes, you may stop using the Platform or terminate your account.

Termination
VauntCourier may, in its sole discretion and without notice, restrict, deny, terminate this Agreement or suspend the Online-Services effective immediately, in whole or in part, for suspicion of fraud, security, illegal activity or unauthorized access issues to protect the integrity of our Online-Services or systems and comply with applicable VauntCourier policy, or if you fail to comply with this Agreement or if you no longer agree to receive electronic communications. Upon termination you must immediately stop using the Online-Services and any outstanding payments will become due. Any termination of this Agreement shall not affect VauntCourier’s rights to any payments due to it. VauntCourier may terminate a free and unused account at any time.  Items listed under “Cancellation, its Effects and Data Survival” in Section 7. will survive and remain in effect even if the Agreement is terminated.

Governing Law
Pennsylvania state law governs this agreement without regard to its conflicts of law's provisions.

 If a user only bought once and then "abandoned" their account, it's basically free!

Arbitration If A Dispute Arises
As defined in Section 2. of the Tax Client Service Agreement.

General
This Agreement is the entire agreement between you and VauntCourier replaces all prior understandings, communications, and agreements, oral or written, regarding its subject matter. If any court of law, having the jurisdiction, rules that any part of this Agreement is invalid, that section will be removed without affecting the remainder of the Agreement. The remaining terms will be valid and enforceable. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement. You cannot assign or transfer ownership of this Agreement to anyone without written approval of VauntCourier.
